MLPA Zoning Committee and the Zoning Process or "Zoning for Dummies" Part 1
Building a fence, adding a deck, building a new garage, are all things that require building permits. If a zoning variance (or re-zoning) is required prior to issuing the building permit, then a meeting with the Morningside Lenox Park Zoning Committee is the first step toward the granting of the variance (or rezoning). The Zoning Committee meets the first Tuesday of each month, 7:30 p.m. at Morningside Presbyterian Church. The Zoning committee members listen to the resident's plans, listen to neighbors' concerns, and review the drawings of the plans. A vote to approve or disapprove of the zoning variance or proposed rezoning is then taken.
This vote is reported at the Morningside Lenox Park Board meeting, the second Monday of each month, 7:30 p.m. at Morningside Presbyterian Church. The homeowner is asked to attend this meeting as well, to answer any questions or concerns the board members might have. MLPA Board members vote their recommendation which is then reported to NPU-F. NPU-F meets the third Monday of each month, 7:30 p.m. at Morningside Presbyterian Church. NPU-F listens to the MLPA Zoning Chair's report of the prior votes and then a vote is taken at the NPU level. All residents of the neighborhood are allowed to vote at this meeting, with the exception of the homeowner involved. At that time, the application goes before the Board of Zoning Adjustment (BZA) for variances or the Zoning Review Board (ZRB) for rezoning. The BZA is the last administrative step in the process for variances. For rezonings, the ZRB votes on the application and this vote is reported to the City Council. The Council votes on the application and the Mayor has the final authority to approve or deny the rezoning application.
